Welcome to CaptureIQ. These Terms of Service ("Terms") govern your use of the CaptureIQ mobile application ("App") provided by DotDotDot ("Company," "we," "our," or "us"). By downloading, installing, or using the App, you agree to be bound by these Terms.

Important: Please read these Terms carefully before using CaptureIQ. If you do not agree to these Terms, you may not use the App.

1. Acceptance of Terms

By accessing or using CaptureIQ, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you are using the App on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. License to Use the App

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on devices that you own or control, solely for your personal, non-commercial purposes.

Subscription purchases are processed through Apple's App Store. By subscribing:

We may offer a free trial period for premium features. The trial period details will be displayed before you confirm your subscription. If you do not cancel before the trial ends, you will be automatically charged for the subscription.

3.4 Price Changes

We reserve the right to change subscription prices. Any price changes will take effect at the start of your next subscription period following notice of the change. Your continued use of the premium features after the price change becomes effective constitutes your agreement to pay the modified amount.

4. Cancellation Policy

4.1 How to Cancel

You may cancel your subscription at any time through your Apple ID account settings:

  1. Open the Settings app on your iOS device
  2. Tap your name at the top
  3. Tap "Subscriptions"
  4. Select CaptureIQ
  5. Tap "Cancel Subscription"

4.2 Effect of Cancellation

When you cancel your subscription:

Apple Handles All Refunds: All purchases are made through Apple's App Store, and Apple manages all refund requests. We do not process refunds directly.

To request a refund for any purchase made through the App Store:

  3. Select the purchase you wish to request a refund for

5.2 Refund Eligibility

Refund eligibility is determined by Apple in accordance with their policies. We recommend requesting a refund within 14 days of purchase if you are not satisfied with the App.

You agree not to use CaptureIQ for any purpose that is unlawful or prohibited by these Terms. Prohibited uses include, but are not limited to:

7. Intellectual Property

7.1 Our Intellectual Property

The App and all content, features, and functionality (including but not limited to design, graphics, text, images, software, and code) are owned by DotDotDot and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

7.2 Your Content

You retain all ownership rights to documents and content you create using the App. We claim no ownership or license to your content. Since all content is stored locally on your device, we have no access to your content.

7.3 Feedback

If you provide us with any feedback, suggestions, or ideas regarding the App, you grant us a non-exclusive, worldwide, royalty-free, irrevocable license to use, modify, and incorporate such feedback into our products and services.

8. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

11.1 Informal Resolution

Before filing a formal claim, you agree to try to resolve any dispute informally by contacting us at support@dotdotdot.app. We will attempt to resolve the dispute within 30 days.

11.2 Binding Arbitration

If we cannot resolve a dispute informally, any controversy or claim arising out of or relating to these Terms shall be settled by binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall be conducted in English, and the arbitrator's decision shall be final and binding.

11.3 Class Action Waiver

You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration.

11.4 Exceptions

Notwithstanding the above, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement of intellectual property rights.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. Any legal action or proceeding not subject to arbitration shall be brought exclusively in the federal or state courts located in San Francisco County, California.

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by:

These Terms, together with our Privacy Policy, constitute the entire agreement between you and DotDotDot regarding the use of the App and supersede all prior and contemporaneous understandings, agreements, representations, and warranties.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. The waiver of any such right or provision will be effective only if in writing and signed by a duly authorized representative of DotDotDot.
