Terms of Service

Welcome to CaptureIQ. These Terms of Service ("Terms") govern your use of the CaptureIQ mobile application ("App") provided by DotDotDot ("Company," "we," "our," or "us"). By downloading, installing, or using the App, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using CaptureIQ, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you are using the App on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. License to Use the App

2.1 Grant of License

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on devices that you own or control, solely for your personal, non-commercial purposes.

2.2 License Restrictions

You may not:

• Copy, modify, or distribute the App or any content within it
• Reverse engineer, decompile, or disassemble the App
• Rent, lease, lend, sell, or sublicense the App
• Remove, alter, or obscure any proprietary notices on the App
• Use the App for any commercial purpose without our written consent
• Use the App in any way that violates applicable laws or regulations
• Attempt to gain unauthorized access to any portion of the App

3. Subscription Terms

3.1 Subscription Options

CaptureIQ offers the following subscription options:

• Free Tier: Basic scanning functionality with limited features
• CaptureIQ Premium (Monthly): Full access to all features on a monthly billing cycle
• CaptureIQ Premium (Yearly): Full access to all features at a discounted annual rate
• CaptureIQ Lifetime: One-time purchase for permanent access to all premium features

3.2 Billing and Renewal

Subscription purchases are processed through Apple's App Store. By subscribing:

• Payment will be charged to your Apple ID account at confirmation of purchase
• Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period
• Your account will be charged for renewal within 24 hours prior to the end of the current period
• You can manage and cancel your subscriptions by going to your App Store account settings

3.3 Free Trial

We may offer a free trial period for premium features. The trial period details will be displayed before you confirm your subscription. If you do not cancel before the trial ends, you will be automatically charged for the subscription.

3.4 Price Changes

We reserve the right to change subscription prices. Any price changes will take effect at the start of your next subscription period following notice of the change. Your continued use of the premium features after the price change becomes effective constitutes your agreement to pay the modified amount.

4. Cancellation Policy

4.1 How to Cancel

You may cancel your subscription at any time through your Apple ID account settings:

1. Open the Settings app on your iOS device
2. Tap your name at the top
3. Tap "Subscriptions"
4. Select CaptureIQ
5. Tap "Cancel Subscription"

4.2 Effect of Cancellation

When you cancel your subscription:

• You will continue to have access to premium features until the end of your current billing period
• Your subscription will not renew at the end of the billing period
• After the billing period ends, you will retain access to free features only
• Your scanned documents and data will remain on your device

5. Refund Policy

5.1 Requesting a Refund

To request a refund for any purchase made through the App Store:

1. Visit reportaproblem.apple.com
2. Sign in with your Apple ID
3. Select the purchase you wish to request a refund for
4. Follow Apple's instructions to submit your request

5.2 Refund Eligibility

Refund eligibility is determined by Apple in accordance with their policies. We recommend requesting a refund within 14 days of purchase if you are not satisfied with the App.

6. Prohibited Uses

You agree not to use CaptureIQ for any purpose that is unlawful or prohibited by these Terms. Prohibited uses include, but are not limited to:

• Scanning, storing, or sharing documents containing illegal content
• Violating any applicable local, state, national, or international law
• Infringing upon the intellectual property rights of others
• Scanning documents without proper authorization
• Using the App to commit fraud or identity theft
• Distributing malware or other harmful software
• Interfering with or disrupting the App or servers
• Attempting to bypass any security measures of the App
• Using the App to harass, abuse, or harm others
• Collecting personal information about others without consent

7. Intellectual Property

7.1 Our Intellectual Property

The App and all content, features, and functionality (including but not limited to design, graphics, text, images, software, and code) are owned by DotDotDot and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

7.2 Your Content

You retain all ownership rights to documents and content you create using the App. We claim no ownership or license to your content. Since all content is stored locally on your device, we have no access to your content.

7.3 Feedback

If you provide us with any feedback, suggestions, or ideas regarding the App, you grant us a non-exclusive, worldwide, royalty-free, irrevocable license to use, modify, and incorporate such feedback into our products and services.

8. Disclaimer of Warranties

To the fullest extent permitted by law, we disclaim all warranties, including but not limited to:

• Implied warranties of merchantability, fitness for a particular purpose, and non-infringement
• Warranties that the App will be uninterrupted, error-free, or secure
• Warranties regarding the accuracy, reliability, or completeness of any content or OCR results
• Warranties that the App will meet your requirements

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

• IN NO EVENT SHALL DOTDOTDOT, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.
• OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.
• THESE LIMITATIONS APPLY REGARDLESS OF THE THEORY OF LIABILITY AND EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

10. Indemnification

You agree to indemnify, defend, and hold harmless DotDotDot and its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including attorney's fees) arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any third-party rights, including intellectual property rights
• Any content you create, store, or share using the App

11. Dispute Resolution

11.1 Informal Resolution

Before filing a formal claim, you agree to try to resolve any dispute informally by contacting us at support@dotdotdot.app. We will attempt to resolve the dispute within 30 days.

11.2 Binding Arbitration

If we cannot resolve a dispute informally, any controversy or claim arising out of or relating to these Terms shall be settled by binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall be conducted in English, and the arbitrator's decision shall be final and binding.

11.3 Class Action Waiver

You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration.

11.4 Exceptions

Notwithstanding the above, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement of intellectual property rights.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. Any legal action or proceeding not subject to arbitration shall be brought exclusively in the federal or state courts located in San Francisco County, California.

13. Changes to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by:

• Updating the "Last Updated" date at the top of these Terms
• Providing notice through the App
• Sending an email if you have provided one

Your continued use of the App after any changes constitutes your acceptance of the new Terms.

14. Termination

We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination:

• Your license to use the App will immediately cease
• Your locally stored data remains on your device
• Provisions that by their nature should survive termination will survive

15. Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and DotDotDot regarding the use of the App and supersede all prior and contemporaneous understandings, agreements, representations, and warranties.

17. Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. The waiver of any such right or provision will be effective only if in writing and signed by a duly authorized representative of DotDotDot.
